5.2 TECHNICAL PROTECTION MEASURES
The Application/Platform includes a digital rights management system based on technical protection measures (‘TPM’) designed to technically protect intellectual property rights relating to Content by controlling access to and use of the LIGUE 1+ Service via the Platform/Application.
The purpose of TPMs is to preserve the Content and prevent any reproduction, modification or piracy, in particular by ensuring any territorial access restrictions and automatic security measures.
The User/Subscriber undertakes to comply with the TPMs implemented on the LIGUE 1+ Service and not to attempt to circumvent and/or defeat their application. The User/Subscriber declares that they are aware that the TPM may limit or revoke their access to one or more pieces of Content, as well as the uses that may be made of it, which they expressly accept.
ARTICLE 6 : FINAL PROVISIONS
6.1
The Subscriber expressly agrees in advance (i) that their Subscription contract may be assigned by Filiale LFP 2 to any third-party company or any company belonging to the same group, provided that such assignment does not entail any reduction of the Subscriber’s rights and that the assignee is able to ensure the continued performance of the Subscription contract under conditions that are at least equivalent, and (ii) that the assignment of their Subscription contract releases Filiale LFP 2 from the obligations relating to the performance of the Subscription contract as from the date of assignment. The Subscriber will be informed, on a durable medium and within a reasonable period before the effective date of the assignment, of the identity of the assignee, the effective date of the assignment, and the terms under which the Subscriber may, where applicable, terminate their contract.
Filiale LFP 2 reserves the right to carry out any restructuring operation, including any merger, acquisition, sale of shares, or contribution of assets. Such operations do not, in themselves, entail any change of the contracting party under these T&C.
6.2 SEVERABILITY
If any provision of these T&C is found invalid or unenforceable under applicable law or court ruling, it shall be considered void without affecting the validity of the remaining clauses.
6.3 FORCE MAJEURE (ACTS OF GOD)
FILIALE LFP 2 and the Subscriber are released from their respective obligations in the event of force majeure, as defined under Article 1218 of the French Civil Code. Force majeure includes events beyond the party’s control that could not reasonably have been foreseen and prevent performance despite best efforts.
6.4 DISPUTE RESOLUTION, MEDIATION, AND GOVERNING LAW
These T&C are governed by French law. However, if the Subscriber is a consumer residing in the Territory, this choice of law shall not deprive them of the protection afforded by the mandatory provisions of the law of their country of residence.
In the event of a dispute that cannot be resolved amicably, jurisdiction shall lie with the competent French courts, unless otherwise provided by mandatory local consumer protection laws.
In the event of a dispute relating to the interpretation, performance, or termination of these Terms and Conditions, the Subscriber or User is invited to first seek an amicable resolution by contacting FILIALE LFP 2 customer support at: support-ott@l1.fr
6.5 MEDIATION
In accordance with applicable consumer protection laws, the Subscriber or User is informed of their right to resort to Alternative Dispute Resolution (ADR) mechanisms, including mediation, before initiating any legal proceedings.
United Kingdom: The User or Subscriber can use certified ADR services like ProMediate or CEDR. While companies are not required to take part, courts encourage trying ADR first.
European Union: For cross-border disputes within the EU, the Mediation Directive (2008/52/EC) applies. It ensures that mediation is confidential, voluntary, and does not affect the right to bring the matter before a court. The European Commission offers an online dispute resolution platform accessible here: http://ec.europa.eu/consumers/odr/
